Terms and conditions of non-exclusive transfer of Izvestia JSC copyright
All rights for materials published in Izvestia newspaper, its supplements, special issues and on Izvestia websites, hereinafter referred to as materials, are reserved by Izvestia Newspaper Joint Stock Company, hereinafter referred to as Company, with exception for the materials copyright for which is indicated within materials themselves or in credits thereto, such as materials provided by news agencies. In order to obtain rights for such materials, please, apply to relevant copyright holders.
The Company shall grant non-exclusive rights for one-time reproduction of materials in client's printed titles and (or) on websites against written client's application.
Long-term agreements may be made with clients who intend to reproduce the Company's materials regularly.
Clients shall not transfer the materials granted to them to third parties without prior written consent of the Company. Infringement of the Company's exclusive copyright shall be subject to liability pursuant to the Civil Code of the Russian Federation and the Russian Federation law On Copyright and Allied Rights.
Clients' applications for use of the Materials e-mailed to e-izvestia@izvestia.ru or faxed to +7-495-648-13-98 shall indicate that a client is aware of these Terms set forth by the Company and agrees to comply with them.
The Company shall process an application within one business day upon receipt and shall send a client an invoice for materials use.
Fees for materials' use shall be agreed upon by the parties depending on type of the title that intends to republish the material, the language in which the material should be provided, as well as on value of the material as in the Company's judgment.
The Company's invoices for materials use shall be paid for by bank transfers to the bank accounts indicated therein.
Clients shall obtain rights for materials' use upon receipt of the payment for the materials' use by the Company of which the Company shall notify the Client and, if required, send him the material in the format agreed upon by the parties, in Russian or in English, by the communication means agreed upon by the parties.
Any alterations and (or) abridgements of the materials intended for reproduction shall not be done without the Company's written consent. It is not allowed to make alterations and (or) abridgements that could change general content of a material, its meaning and (or) tone and (or) that may result in offence or humiliation of a person or infringement of property and (or) moral rights of any person or entity, or the laws in force.
Should a client makes such alterations without the Company's consent, he will be fully answerable to third persons and (or) entities and the law. Should such alterations result in claims and (or) litigations to the Company, the client who infringed this provision shall repair all damages and costs of such claims and (or) suits settlement to the Company, including lawyers' fees.
Reproducing a material, the client shall indicate the source where the material was first published, the first publication date and the author's name. Should such credits are not published, the client shall pay US$ 100.00 penalty, and in case of a material reproduction without the Company's consent he will pay US$ 500 penalty. The client shall not be in position to object the penalty payment.
In order to obtain the Company's permission for reproduction, the client should forward a request to the Company where the following should be indicated:
